PAIA Manual

1. Introduction

This manual has been prepared in accordance with section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA") for Verify Now ("the Company"). This manual sets out the procedure to be followed when requesting information from the Company in terms of PAIA.

3. Guide on How to Use PAIA

The South African Human Rights Commission has published a guide on how to use PAIA. This guide is available at the offices of the South African Human Rights Commission and on its website: www.sahrc.org.za.

4. Records Available in Terms of Other Legislation

Records are kept in accordance with such other legislation as is applicable to the Company, which includes but is not limited to:

  • Companies Act 71 of 2008
  • Income Tax Act 58 of 1962
  • Value Added Tax Act 89 of 1991
  • Labour Relations Act 66 of 1995
  • Basic Conditions of Employment Act 75 of 1997
  • Employment Equity Act 55 of 1998
  • Skills Development Act 97 of 1998
  • Unemployment Insurance Act 63 of 2001

5. Access to Records Held by the Company

The following categories of records are held by the Company:

  • Personnel Records
  • Customer Records
  • Company Records
  • Financial Records
  • Marketing Records

Personnel Records include personal details, employment history, and other related information of employees. Customer Records include personal details, purchase history, and other related information of customers. Company Records include incorporation documents, minutes of meetings, and other related information. Financial Records include financial statements, tax records, and other related information. Marketing Records include marketing strategies, advertising materials, and other related information.

6. Request Procedure

A person who wants access to the records of the Company must complete the necessary request form. The request form can be accessed on www.justice.gov.za. The completed request form must be sent to the address or email address provided in this manual, and marked for the attention of the Information Officer.

The request must provide sufficient details to enable the Company to identify:

  • The record(s) requested
  • The requester (and if an agent is lodging the request, proof of capacity)
  • The form of access required
  • The postal address or fax number of the requester in the Republic
  • If the requester wishes to be informed of the decision in any manner (in addition to written) the manner and particulars thereof
  • The right which the requester is seeking to exercise or protect with an explanation of the reason the record is required to exercise or protect the right

7. Availability of the Manual

This manual is available for inspection at the offices of the Company free of charge. Copies of the manual may be obtained, subject to the prescribed fees. The manual is also available on the Company's website (verifynow.co.za).

The manual is also available at the South African Human Rights Commission and the National Library of South Africa.

8. Fees

The fee for a copy of the manual as contemplated in regulation 9(2)(c) is R1,10 for every photocopy of an A4-size page or part thereof. The fees for reproduction are as prescribed in PAIA.

The requester must pay the prescribed fee before any processing of the request can take place.

If the preparation of the record requested requires more than the prescribed hours, a deposit shall be paid (of not more than one third of the access fee which would be payable if the request were granted).

A requester may lodge an application with a court against the tender/payment of the request fee and/or deposit.
